General Terms and Conditions
Article 1 – Definitions
For the purposes of these terms and conditions:
Trader: IWT Motorcycle Custom Parts, located at Wendelenkamp 53, 7091 TV Dinxperlo, Netherlands, Chamber of Commerce number (KvK) 82189749, trading under the name IWT Motorcycle Custom Parts.
Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the trader.
Distance contract: a contract whereby exclusive use is made of one or more means of communication at a distance.
Right of withdrawal: the period within which the consumer may exercise the right of withdrawal.
Article 2 – Applicability
These general terms and conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer.
Before the contract is concluded, the text of these general terms and conditions is made available to the consumer.
Article 3 – The offer
If an offer has a limited period of validity or is subject to conditions, this will be clearly stated.
The offer contains a complete and accurate description of the products offered.
Obvious errors or mistakes in the offer are not binding on the trader.
Article 4 – The contract
The contract is concluded at the moment the consumer accepts the offer and fulfils the conditions set.
The trader confirms the conclusion of the contract to the consumer without delay by email.
Article 5 – Right of cancellation
The consumer has the right to cancel the contract within 14 days without giving any reason. The cancellation period expires 14 days after the day on which the consumer, or a third party designated by the consumer other than the carrier, physically receives the goods.
The consumer must inform the trader unequivocally of the decision to cancel the contract before the cancellation period expires. The goods may only be returned after this notification has been made.
The consumer may also exercise the right of cancellation electronically via our cancellation function on our website. You can find it under „Withdraw from contract“. After submitting the notification, the consumer will immediately receive confirmation of receipt of the cancellation by email.
The consumer must handle the product carefully during the cancellation period and may only use and inspect it to the extent necessary to establish the nature, characteristics and functioning of the product. If the product is mounted or used, the consumer must ensure that the product is returned in the same condition in which it was received. The product must show no signs of mounting, use, damage or other diminished value when returned. If such signs are present, the resulting diminished value will be deducted from the amount to be refunded. If the product can no longer be sold as new due to such signs, the diminished value may amount to 100% of the product value.
The right of cancellation does not apply to goods manufactured according to the consumer’s specifications or clearly personalised for a specific person.
Article 6 – Costs in case of cancellation
If the consumer exercises the right of cancellation, the consumer bears the costs of returning the goods.
The consumer also bears the risk of the return shipment, in particular if the return shipment cannot be proven and the goods do not reach the trader.
The costs paid by the trader to PayPal, the credit card company or another payment service provider for the original payment will not be refunded to the consumer in the event of cancellation.
The trader will refund the purchase amount, including the shipping costs paid at the time of the order, within 14 days after receipt of the returned goods.
If the consumer has chosen a more expensive shipping method, the additional costs will not be refunded.
Article 7 – The price
The prices stated in the offers for products include VAT and exclude shipping costs, unless otherwise stated.
The prices stated on the website apply during the period specified in the offer.
Obvious errors in the price or other information in the offer are not binding on the trader.
Article 8 – Delivery and performance
The trader will exercise the greatest possible care when receiving and carrying out orders for products.
The place of delivery is the address that the consumer has made known to the trader.
The trader will carry out accepted orders with due speed, but no later than within 30 days, unless another delivery period has been agreed.
If delivery is delayed, or if an order cannot be carried out or can only be partially carried out, the consumer will be informed as soon as possible.
The risk of loss and damage to the product remains with the trader until the moment of delivery to the consumer or a third party designated by the consumer who is not the carrier.
Article 9 – Payment
Payment must be made in advance using the payment methods offered on the website.
The available payment methods are iDEAL, PayPal and credit card.
No additional costs are charged for these payment methods.
Article 10 – Complaints procedure
The trader has a sufficiently publicised complaints procedure and handles complaints in accordance with this complaints procedure.
Complaints about the performance of the contract must be submitted to the trader, fully and clearly described, within a reasonable period after the consumer has discovered the defects, via the contact form or by email.
Complaints submitted to the trader will be answered within 14 days from the date of receipt.
If a complaint requires a foreseeably longer processing time, the trader will respond within the 14-day period with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed response.
Article 11 – Disputes
Contracts between the trader and the consumer to which these general terms and conditions relate are governed by Dutch law.
Disputes will be submitted to the competent court in accordance with the applicable statutory rules.
Article 12 – Intellectual property
All intellectual property rights relating to the website, including texts, images, designs, logos and other content, are vested in the trader or its licensors.
